    Prospecting rights: how to apply

    A prospecting right under Section 16 of the MPRDA lets you explore for specific minerals on a defined area for up to five years, renewable once for three. You need a prospecting work programme, proof of funding and technical ability, and environmental authorisation.

    What you need

    • A registered company or eligible applicant.
    • Prospecting work programme with phased budget.
    • Proof of financial and technical ability.
    • Environmental authorisation, usually a basic assessment.
    • Consultation with the landowner and interested parties.

    Term and renewal

    The initial term is up to five years. One renewal of up to three years is possible if you have met the work programme and reporting obligations.

    After prospecting

    The holder of a prospecting right has the exclusive right to apply for a mining right over the same area and minerals.

    How long does a prospecting right take?

    Typically 6 to 12 months, depending on the environmental process and objections.

    Can I sell minerals found while prospecting?

    Only with the Minister's written permission to remove and dispose of them.

    Can I transfer a prospecting right?

    Yes, with the Minister's consent under Section 11 of the MPRDA.
