Mineral rights: frequently asked questions

Do I still own mineral rights under South African law?
No, minerals vest in the state under the MPRDA. What you hold is a statutory right to prospect or mine, such as a prospecting right or mining right, not common law mineral rights.
How do I renew a mining right?
You lodge a renewal application under section 24 of the MPRDA before the current right expires, showing compliance with the existing work programme and social and labour plan.
What is a section 102 amendment?
It is the ministerial consent required under section 102 of the MPRDA to amend a right, work programme, environmental management programme or social and labour plan.
Do I need to register a mining right?
Yes, registration at the Mineral and Petroleum Titles Registration Office perfects the right and makes it enforceable against third parties.
What is a retention permit?
A permit under section 32 letting a prospecting right holder retain a defined resource for up to 3 years, renewable once, where mining is not yet viable.
Can I cede a mineral right to another company?
Only with section 11 ministerial consent under the MPRDA, obtained before the cession takes effect.
What happens if a mining right lapses?
A lapsed right cannot simply be revived, so the area may become available for a new application by another party. Renewal deadlines should be tracked well ahead of expiry.
How much does mineral rights administration cost?
